welcome to our legal terms and conditions under which we supply the products listed on our website www.chokonzept.com to you. please read these terms and conditions carefully before you order any products from our site.

eligibility

you can purchase from us only if you are legally capable of entering into a binding contract with us in accordance to the french law.

please provide us with your true, current and complete personal data including your name, email adresse, telephone number, delivery adresse, payment details in order to place your order on www.chokonzept.com.

our products are exclusively intended to be sold to end consumers without any intention of reselling our products.

orders

by placing an order you express acceptance of our terms and conditions and a legally binding contract is formed between us as follows:

you select the product that you want to order. the product is put in your basket. you have the opportunity to check your basket including your selected elements and may modify or delete the elements within before ordering.

you complete the identification form including your titel, name, surname, e-mail, phone number, delivery address and payment details. you place your order. please notice that no changes can be made to the data (including name and delivery address) you provided for your order, once the order is placed.

afterwards you shall receive an information from us to confirm that we received your order. we contact your bank to take payment from your account. once your payment has been made in full, we will accept your order. the contract between us is formed.

you will receive an order confirmation email from us. this receipt includes your name, the number of your order, the date of your order, your delivery and invoicing address, the delivery method you selected, the list of products you ordered.

this is the proof of your order and we recommend you keep it. please contact us if you do not receive this notice.

we may refuse your order without mentioning any reason.

availability

your order may not be accepted if we did not receive your payment or the product you ordered is out of stock. cho konzept informs you as soon as possible if any product is no longer available. cho konzept may not be held liable in case of unavailability of the product.

price and payment

price

the prices indicated on our website are in euro and include value added tax vat (or a similar sales tax). we cannot offer you a vat refund service for any purchases at cho konzept.

the amount you pay is the indicated price plus any delivery charges. the delivery charges depend on the delivery option that you choose. you will see them at the checkout process, before the validation of your order.

if delivery is made to countries outside of the european union or your payment is initiated outside of the european union, additional costs, such as duties, taxes or money transfer fees or foreign exchange fees, may arise and which you must bear. you are responsible to verify the possibility of importation of our products in your country. you are in charge of all formalities linked to the importation.

the price must be paid in full when ordering.

cho konzept retains the right to modify the prices at any time without prior notice.

payment methods

payment can be made by credit card.

delivery

we can make deliveries in austria, belgium, bulgaria, croatia, czech republic, denmark, estonia, finland, france, germany, greece, hungary, ireland, italy, latvia, luxembourg, netherlands, poland, portugal, romania, slovakia, slovenia, spain, sweden.

the product will be delivered to you accordingly to the delivery option you have selected. delivery costs will be charged according to your order value, size and destination. you shall bear this cost.

delivery time depends on the destination. our average delivery time is within 3-9 working days from the date of the contract (order confirmation). working days refer to all days excluding saturday, sunday, public holidays. we will give our best effort to deliver accordingly to this estimated delivery time, although we cannot guarantee the delay mentioned above.

cho konzept cannot be held responsible for any delays or additional cost in delivery over which we have no control.

in case the delivery time is longer as indicated, you do not have any right to cancel the order or to any reduction in price. however, if the delivery delay exceeds 30 days, you may cancel the order without any cost according to the consumer code article l.121-20-3.

please refer to the delivery options for international delivery.

in case you provided us with an incomplete or incorrect address or we lack any other information that makes it impossible to deliver the parcel to you, you are responsible and cho konzept cannot be held liable for the completion of the delivery. in case you wish a second delivery, you must bear the cost for occurring fees.

in case you are absent the delivery will be presented to you again, dropped off at a point of delivery, kept at the carriers warehouse or returned to cho konzept, accordingly to the terms and conditions of the carrier.

in case the delivery is returned to us by the carrier, we will not make another attempt to deliver.

ownership and risk

the goods remain our property until the purchase price is paid in full by you and received by us.

you assumes the risk (including of loss, theft or deterioration) for the delivered products from the time that they are delivered to the address you indicated at the time you placed your order.

inspection

you shall inspect the products upon receipt. please check that everything we specified is included. we assume that you accept the order unless you notify us right away.

we recommend you keep the note attached to your parcel as proof of delivery.

cancellation, returns and refunds

as a consumer, the legal right articles l 221-18 et seq. of the french consumer code allows you to cancel a contract within 14 days from the delivery date of the product. in case you change your mind or want to return the product for any other reason, you can inform us to cancel our contract and request a refund. this right applies to products on sale.

this right to return does not apply in case you removed the products from their original packaging and used them or tried them on due to health protection and hygiene reasons.

if you decide to cancel your order, please send us an email to hello@chokonzept, mentioning your order reference and the reason for your cancellation. right after, you must return the product to us in its original product packaging and unopened in undue delay. you must bear the delivery cost. please request the address for returns by email to hello@chokonzept. we will send you an authorization for return and a return number that you must enclose to your parcel. please make sure to write the return number on the parcel. no return will be accepted if the return number and authorization is missing.

make sure to keep your proof of postage as cho konzept cannot be held responsible for items lost or damaged in transit. you must provide the tracking number per email to cho konzept.

cho konzept will refund you by bank transfer to the card you used to pay for your original order. if we refund any payment for the products to you, the legal ownership of the products will immediately transfer back to us. however, you are hold responsible for any loss, damage or theft until we receive your return parcel including the elements mentioned above, in the products original unopened packaging.

we cannot replace or exchange returned products. a new order must be placed.

force majeure

force majeure refers to all external unforeseeable and unavoidable circumstances, beyond the reasonable control of the party which is suffering a force majeure case.

cho konzept will not be hold responsible to the other party under this agreement for failure or delay in performing any obligation of this agreement resulting from causes beyond the reasonable control of cho konzept.
